Chapter I: General Provisions
Article 1: This Law is drafted so as to carry forward the Chinese nation's fine tradition of attaching importance to family education, to guide the entire society to pay attention to family, family education, and family style, to increase family happiness and social harmony, and to cultivate socialist builders and successors with all-round development of morality, intelligence, physical fitness, aesthetics, and labor.
Article 2: "Family education" as used in this Law refers to the cultivation, guidance, and influence of parents or other guardians on minors' moral character, physical fitness, life skills, cultural accomplishments, behavioral habits, and so forth, so as to promote their comprehensive and healthy growth.
Article 3: Family education is to have the fundamental task of cultivating morality and cultivating people, cultivating and practicing the Core Socialist Values, carrying forward the excellent traditional culture, revolutionary culture, and advanced socialist culture of the Chinese nation, and promoting the healthy growth of minors.
Article 4: Minors' parents or other guardians are responsible for carrying out family education.
The State and society provide guidance, support and services for family education.
State employees shall take the lead in establishing a positive family style and performing family education responsibilities.
Article 5: Family education shall meet the following requirements:
(1) Respect the laws of minors' physical and psychological development and individual differences;
(2) Respect the personal dignity of minors, protect minors' privacy and personal information, and safeguard minors' lawful rights and interests;
(3) Follow the characteristics of family education, and implement scientific concepts and methods of family education;
(4) Family education, school education, and social education are closely integrated and coordinated;
(5) Adopt flexible and diverse measures in light of the actual situation.
Article 6: All levels of people's government are to guide family education efforts, and establish and complete mechanisms for family-school social collaborative education. The bodies of people's governments at the county level or above responsible for work on women and children are to organize, coordinate, guide, and urge relevant departments to do a good job of family education work.
The administrative departments for education and women's federations are to coordinate and coordinate social resources, coordinate efforts to advance the establishment of a family education guidance service system covering both urban and rural areas, and undertake routine affairs of family education work in accordance with their duties and division of labor.
Departments for the establishment of spiritual civilization at the county level or above, and relevant departments of people's governments at the county level or above, such as for public security, civil affairs, judicial administration, human resources and social security, culture and tourism, health, market oversight and management, radio and television, sports, press and publication, and internet information, are to do a good job of family education work within the scope of their respective duties.
Article 7: People's governments at the county level or above shall draft special plans for family education work, include family education guidance services in the urban and rural public service system and government procurement service catalogs, include relevant funds in fiscal budgets, and encourage and support the provision of family education guidance through government procurement of services.
Article 8: People's courts and people's procuratorates are to give play to their functions and roles, cooperating with the people's governments at the same level and their relevant departments to establish linkage mechanisms for family education work, and jointly do a good job of family education work.
Article 9: Trade unions, Communist Youth Leagues, Disabled Persons' Federations, science and technology associations, working committees for the care of the next generation, residents' committees, villagers' committees, and so forth, shall actively carry out family education efforts in conjunction with their own work, and provide social support for family education.
Article 10: The State encourages and supports enterprises, public institutions, social organizations, and individuals in carrying out public interest family education service activities in accordance with law.
Article 11: The state encourages the development of research on family education, encourages schools of higher learning to establish specialized courses on family education, supports normal schools and schools of higher learning that have the capacity to strengthen the establishment of family education disciplines, cultivates professional personnel for family education services, and carries out training for family education service personnel.
Article 12: The state encourages and supports natural persons, legal persons, and unincorporated organizations in making donations or providing volunteer services for family education, and where those who meet the requirements are to give tax benefits in accordance with law.
The state is to give commendations and awards to organizations and individuals that have made outstanding contributions to family education work in accordance with relevant provisions.
Article 13: The week of the International Day of Families on May 15 of each year is the National Family Education Publicity Week.
Chapter II: Family Responsibilities
Article 14: Parents or other guardians shall establish a sense of responsibility that the family is the first classroom and parents are the first teacher, bear primary responsibility for carrying out family education for minors, and use correct thinking, methods, and conduct to educate minors to develop positive thoughts, conduct, and habits.
Other family members living together with full capacity for civil conduct shall assist and cooperate with the minors' parents or other guardians in carrying out family education.
Article 15: Minors' parents or other guardians and other family members shall emphasize family building, cultivating a positive and healthy family culture, establishing and passing on positive family practices, carrying forward the family virtues of the Chinese nation, jointly building civilized and harmonious family relationships, and creating a positive family environment for the healthy growth of minors.
Article 16: Minors' parents or other guardians shall carry out family education based on the characteristics of minors' physical and psychological development of different ages, using the following content as a guide:
(1) Educate minors to love the Party, the country, the people, the collective, and socialism, establish the concept of preserving national unity, forge a strong sense of community for the Chinese nation, and cultivate feelings for the family and country;
(2) Educate minors to respect virtue and goodness, respect the elderly, love the young, love the family, be diligent and thrifty, unite and help each other, be honest and friendly, and abide by discipline and law, and cultivate their awareness of good social morality, family virtues, personal morality, and the rule of law;
(3) Assist minors in establishing a correct outlook on success, guiding them to cultivate a wide range of interests and hobbies, healthy aesthetic pursuits, and positive study habits, and increasing the spirit of scientific exploration, awareness and ability to innovate;
(4) Ensure that minors have balanced nutrition, scientific exercise, adequate sleep, and physical and mental pleasure, guiding them to develop positive living habits and behavioral habits, and promoting their physical and psychological development;
(5) Pay attention to minors' mental health, teach them to cherish life, educate them on safety knowledge in areas such as transportation, healthy internet access, and prevention of bullying, drowning, fraud, trafficking, and sexual assault, to help them master safety knowledge and skills, and increase their awareness and ability to protect themselves;
(6) Help minors establish a correct concept of labor, participate in work within their capabilities, increase their ability to take care of themselves and live independently, and develop an excellent character of enduring hardships and standing hard work and a good habit of loving labor.
Article 17: Minors' parents or other guardians carrying out family education shall pay attention to the minors' physical, psychological, and intellectual development, respect their rights to participate in relevant family affairs and express their opinions, and reasonably use the following methods and methods:
(1) Raising children in person and strengthening parent-child accompaniment;
(2) Participate together and give play to the role of both parents;
(3) Teaching with cameras, teaching in daily life;
(4) Imperceptibly, combining words with deeds;
(5) Be strict and benevolent, pay equal attention to care and strict requirements;
(6) Respect differences and conduct scientific guidance based on age and personality characteristics;
(7) Communicate on an equal footing, and respect, understand and encourage them;
(8) Promote each other, and parents and children grow together;
(9) Other methods and methods conducive to the comprehensive development and healthy growth of minors.
Article 18: Minors' parents or other guardians shall establish a correct concept of family education, conscientiously study knowledge of family education, and conduct targeted study during pregnancy and during important periods such as when minors enter infant and child care service establishments, kindergartens, primary and secondary schools, and master scientific methods of family education, increasing capacity for family education.
Article 19: Minors' parents or other guardians shall closely cooperate with primary and secondary schools, kindergartens, infant and child care service establishments, and communities, and actively participate in the public interest family education guidance and practice activities they provide, to jointly promote the healthy growth of minors.
Article 20: Where minors' parents are separated or divorced, they shall cooperate with each other in performing family education responsibilities, and neither party must refuse or neglect to perform; Except as otherwise provided by law, the other party must not be hindered from carrying out family education.
Article 21: Where minors' parents or other guardians lawfully entrust others to care for minors on their behalf, they shall keep in touch with the person entrusted or the minors, periodically learn about the minors' studies, living conditions, and psychological conditions, and jointly perform family education responsibilities with the person being entrusted.
Article 22: Minors' parents or other guardians shall reasonably arrange time for minors' study, rest, recreation, and physical exercise, to avoid increasing minors' study burdens, and to prevent minors from becoming addicted to the internet.
Article 23: Minors' parents or other guardians must not discriminate against minors on the basis of gender, physical condition, intelligence, and so forth, must not carry out domestic violence, and must not coerce, entice, instigate, connive, or exploit minors to engage in activities that violate laws, regulations, or social mores.
Chapter III: State Support
Article 24: The State Council shall organize relevant departments to draft, revise, and promptly promulgate the National Family Education Guidance Outline.
Provincial-level people's governments or districted-city level people's governments that have the capacity shall organize relevant departments to compile or adopt family education guidance textbooks suited to local conditions, and draft corresponding work specifications and assessment specifications for family education guidance services.
Article 25: People's governments at the provincial level or above shall organize relevant departments to make overall plans for the establishment of family education information sharing service platforms, set up public interest online parent schools and online courses, open service hotlines, and provide online family education guidance services.
Article 26: Local people's governments at the county level or above shall strengthen oversight and management, reducing the burden of homework and extracurricular training on students during the compulsory education phase, unblocking channels for communication between schools and families, and promoting mutual cooperation between school education and family education.
Article 27: Local people's governments at the county level or above and relevant departments are to organize the establishment of professional teams for family education guidance services, strengthen the cultivation of professionals, and encourage social workers and volunteers to participate in family education guidance service work.
Article 28: Local people's governments at the county level or above may, in consideration of actual local conditions and needs, designate family education guidance bodies through a variety of channels and methods.
Family education guidance establishments are to conduct guidance for community parent schools, school parent schools, and other family education guidance service sites within their jurisdiction, and at the same time carry out family education research, the establishment and training of service personnel, and the research and development of public service products.
Article 29: Family education guidance establishments shall promptly provide services to families in need.
For families where parents or other guardians have certain difficulties in performing family education responsibilities, family education guidance establishments shall, on the basis of the specific circumstances, coordinate and cooperate with relevant departments to provide targeted services.
Article 30: People's governments at the districted city, county, or township level shall employ measures in consideration of actual local conditions to establish records and cards for the families of left-behind minors and minors in difficulty, provide care services such as livelihood assistance and support for entrepreneurship and employment, and create conditions for the parents or other guardians of left-behind minors and minors in difficult circumstances to carry out family education.
Administrative departments for education and women's federations shall employ targeted measures to provide services to the parents or other guardians of left-behind minors and minors in difficult circumstances in carrying out family education services, guiding them to actively pay attention to minors' physical and psychological health, and strengthen family affection and care.
Article 31: Family education guidance establishments carrying out family education guidance service activities must not organize or indirectly organize for-profit education and training.
Article 32: Marriage registration bodies and adoption registration bodies shall publicize family education knowledge and provide family education guidance to parties handling marriage and adoption registrations through methods such as on-site counseling and counseling, and broadcasting publicity and education films.
Article 33: Child welfare establishments and institutions for the aid and protection of minors shall provide family education guidance to foster families arranged by that establishment, or to the parents or other guardians of minors receiving aid and protection.
Article 34: When people's courts hear divorce cases, they shall provide family education guidance to both husband and wife who have minor children.
Article 35: Women's federations give play to women's unique role in carrying forward the family virtues of the Chinese nation and establishing positive family practices, publicizing and popularizing knowledge of family education, organizing and carrying out family education practice activities through multiple channels such as family education guidance bodies, community parent schools, and the establishment of civilized families, and providing family education guidance services.
Article 36: Natural persons, legal persons, and unincorporated organizations may establish non-profit family education service establishments in accordance with law.
Local people's governments at the county level or above and relevant departments may employ support measures such as government subsidies, rewards and incentives, and the purchase of services, to cultivate family education service establishments.
Relevant departments such as for education, civil affairs, health, and market oversight and management shall conduct guidance and oversight of family education service establishments and practitioners within the scope of their respective duties in accordance with law.
Article 37: State organs, enterprises, public institutions, mass organizations, and social organizations shall include the establishment of family style in the establishment of the unit's culture, and support employees in participating in relevant family education service activities.
Activities such as for the creation of civilized cities, civilized villages and towns, civilized units, civilized communities, civilized campuses, and civilized families shall make family education an important content.
Chapter IV: Social Coordination
Article 38: Residents' committees and villagers' committees may rely on urban and rural community public service facilities to set up community parent schools and other family education guidance service sites, and cooperate with family education guidance establishments to organize publicity on family education knowledge for residents and villagers, and provide family education guidance services to minors' parents or other guardians.
Article 39: Primary and secondary schools and kindergartens shall include family education guidance services in their work plans, and make them the content of teachers' professional training.
Article 40: Primary and secondary schools and kindergartens may employ methods such as establishing parent schools, and based on the characteristics of minors of different ages, periodically organize public interest family education guidance services and practice activities, and promptly contact and urge minors' parents or other guardians to participate.
Article 41: Based on the needs of parents, primary and secondary schools and kindergartens shall invite relevant persons to teach family education concepts, knowledge, and methods, organize and carry out family education guidance services and practical activities, and promote joint education between families and schools.
Article 42: Primary and secondary schools and kindergartens that have the capacity shall, under the guidance of the administrative departments for education, provide support for family education guidance service sites carrying out public interest family education guidance service activities.
Article 43: Where primary and secondary schools discover that minor students have seriously violated school rules and discipline, they shall promptly stop and discipline them, inform their parents or other guardians, and provide their parents or other guardians with targeted family education guidance services; Where minor students are found to have negative conduct or serious negative conduct, it is to be handled in accordance with relevant legal provisions.
Article 44: Infant and child care service establishments and early education service establishments shall provide minors' parents or other guardians with family education guidance services such as scientific parenting guidance.
Article 45: When health care establishments carry out services such as premarital health care, pregnancy and childbirth health care, child health care, and vaccination, they shall carry out publicity and guidance on scientific parenting knowledge and early infant and early development for the parents or other guardians of relevant adults and minors.
Article 46: Libraries, museums, cultural centers, memorial halls, art galleries, science and technology museums, stadiums, youth palaces, children's activity centers, and other public cultural service establishments and patriotic education bases shall periodically carry out public interest family education publicity, family education guidance services, and practice activities each year, and develop public cultural service products for family education.
Radio, television, newspapers, the internet, and other news media shall publicize correct knowledge of family education, disseminate scientific concepts and methods of family education, and create a positive social atmosphere that values family education.
Article 47: Family education service establishments shall strengthen self-discipline and management, draft norms for family education services, organize training for practitioners, and increase the professional quality and capacity of practitioners.
Chapter V: Legal Responsibility
Article 48: Where the residents' committees, villagers' committees, and women's federations for the minor's residence, the units to which the minors' parents or other guardians belong, as well as primary and secondary schools, kindergartens, and other units that have close contact with minors, discover that their parents or other guardians refuse or neglect to perform their family education responsibilities, or unlawfully obstruct other guardians from carrying out family education, they shall criticize and educate them, admonish and stop them, and when necessary, urge them to accept family education guidance.
Where minors' parents or other guardians lawfully retain others to care for minors on their behalf, and relevant units discover that the person entrusted is not lawfully performing family education responsibilities, apply the provisions of the preceding paragraph.
Article 49: Where, in the course of handling a case, public security organs, people's procuratorates, or people's courts discover that minors have serious negative conduct or have committed criminal conduct, or that minors' parents or other guardians have improperly carried out family education and violated minors' lawful rights and interests, they are to reprimand the parents or other guardians based on the circumstances, and may order them to accept family education guidance.
Article 50: In any of the following circumstances, government departments or institutions with family education work duties are to order corrections to be made within a set period of time by the organ at the level above or the unit in charge; where the circumstances are serious, the directly responsible managers and other directly responsible personnel are to be sanctioned in accordance with law:
(1) Failure to perform family education duties;
(2) Withholding, misappropriating, misappropriating, or falsely reporting or fraudulently receiving funds for family education work;
(3) Other situations of abuse of authority, dereliction of duty, or twisting the law for personal gain.
Article 51: Where family education guidance establishments, primary and secondary schools, kindergartens, infant and child care service establishments, or early education service establishments violate the provisions of this Law by not performing or incorrectly performing family education guidance service duties, the competent departments are to order corrections to be made within a set period of time; where the circumstances are serious, the directly responsible managers and other directly responsible personnel are to be sanctioned in accordance with law.
Article 52: In any of the following circumstances, the competent departments are to order corrections to be made within a set period of time; where corrections are refused or the circumstances are serious, the competent departments are to order a suspension of business for rectification, revoke business licenses, or revoke registration:
(1) Failure to go through the formalities for establishment in accordance with law;
(2) Engaging in conduct beyond the scope of licensed business or making false or misleading publicity, resulting in negative consequences;
(3) Violating the lawful rights and interests of minors and their parents or other guardians.
Article 53: Where minors' parents or other guardians commit domestic violence against minors in the course of family education, legal responsibility is to be pursued in accordance with the provisions of the "People's Republic of China Law on the Protection of Minors", the "People's Republic of China Law on Countering Domestic Violence", and other laws.
Article 54: Where violations of the provisions of this Law constitute a violation of the administration of public security, the public security organs are to give public security administrative sanctions in accordance with law; where a crime is constituted, criminal responsibility is pursued in accordance with law.
Chapter VI: Supplementary Provisions
Article 55: This Law takes effect on January 1, 2022.
